District Court for the Eastern District of Michigan Decision on DTE Energy Company and Sierra Club Agreement
(Washington, DC - February 4, 2021) On July 23, 2020, the United States District Court for the Eastern District of Michigan entered a consent decree between the United States, DTE Energy, and Plaintiff-Intervenor Sierra Club resolving DTE’s violations of the Clean Air Act. DTE and Sierra Club also entered into a separate agreement that resolved Sierra Club’s claims in exchange for certain additional injunctive relief terms. The Trump Administration objected to that agreement, arguing that Court approval was required and should not be granted. The Court found that as the separate agreement was a private settlement that no approval was required and dismissed the Sierra Club’s claims based on the separate agreement resolving those claims.
