Guidance: Use and Enforcement of CERCLA Information Requests and Administrative Subpoenas

Memoranda addressing information-gathering tools under sections 104(e) and 122(e)(3)(B) of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA, commonly referred to as Superfund). Issued 8/30/91.

The recommendations included two attachments: (1) a guidance document issued 8/25/1988 on the use and enforcement of information requests and administrative subpoenas, and (2) an updated model language subpoena document. The recommendations provide additional guidance on use of CERCLA section 122 administrative subpoenas.

The 1991 document file omits the 1988 memorandum which is posted separately below.
