BP SETTLEMENT:
A. Violations of VOC Requirements Found at Branded Retail Outlets
There are eleven alleged violations of the VOC requirements found at branded retail outlets under 40 C.F.R. § 80.155(a)(1) which requires gasoline to have greater than or equal to the applicable minimum VOC emissions reduction.
B. Violation of RVP Requirements at a Branded Outlet
An alleged violation of the RVP requirements at 40 C.F.R. § 80.27(a) (2) at a branded retail outlet in Ash Grove, Missouri, where gasoline was distributed which exceeded the RVP standard of 8.3.
C. Violations of the Detergent Regulations for Distribution of Base Gasoline
In 1999, BP allegedly failed to add the required deposit control additive to approximately 4 million gallons of gasoline shipped at 35 BP storage terminals, in violation of 40 C.F.R. § 80.155(a)(1).
D. RVP Violations at the Texas City Refinery
At the Texas City Refinery, there were allegedly eight batches of gasoline produced and distributed that did not comply with the RVP requirements of 40 C.F.R. § 80.27(a) (2).
E. Violation of Annual NOx Standard
BP allegedly violated the annual NOx standard for its Yorktown Refinery.
F. Violation of VOC Region 1 and 2 Requirements
On four occasions, at BP's Carteret Terminal, Whiting Refinery and Global Revier Terminal, BP allegedly violated 40 C.F.R. § 80.78(a) by distributing gasoline that did not comply with the VOC requirements for reformulated gasoline.
MOTIVA/EQUILON SETTLEMENT:
A. Violations of VOC Requirements Found at Branded Retail Outlets
There are nineteen alleged violations of the VOC requirements found at branded retail outlets under 40 C.F.R. § 80.155(a)(1) which requires gasoline to have greater than or equal to the applicable minimum VOC emissions reduction.
B. Violation of RVP Requirements at a Branded Outlet
There are three alleged violations of the RVP requirements at 40 C.F.R. § 80.27(a) (2) at a branded retail outlet, where gasoline was distributed which exceeded the RVP standard
C. Violations of the VOC Requirements Found at Bridgeport Refinery
There was one occasion where reformulated gasoline allegedly had an emissions reduction percentage which was not greater than or equal to the applicable minimum percentage specified in 40 C.F.R. § 80.41.
D. Contamination of Product at Delaware City Refinery and Terminal
Approximately 588,000 gallons of reformulated gasoline was allegedly distributed to approximately 83 retail outlets that did not complied with applicable standards for oxygen content, and/or aromatics in violations of 40 C.F.R. 80.78(a).
E. Contamination of Product at St. Louis,Missouri Equilon Terminal
On one occasion gasoline allegedly containing excess ethanol was distributed from the St. Louis terminal in violation of 40 C.F.R. § 80.78(a).
F. RVP Violations at the Wood River Refinery
At the Wood River Refinery, there were seven alleged violations of the RVP requirements in violation of 40 C.F.R. § 80.27(a) (2) for distribution of gasoline that did not comply with the RVP standard.
G. Oxygen Content Violations
On four occasions, at Motiva/Equilon's North St. Louis, St. Louis, Granville and the Argo Illinois Terminals, Motiva/Equilon allegedly violated 40 C.F.R. § 80.78(a) by distributing gasoline that did not comply with the oxygen content requirements for reformulated gasoline.
