Superfund 104(e) Information Request Questions by Category
Under section 104(e) of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA, commonly referred to as Superfund), EPA is authorized to seek information involving sites containing hazardous substances.
With input from the Agency's regional offices, EPA compiled into 35 categories sample questions for information request letters tailored to the type of site (e.g., chemical plants, dry cleaners), sophistication of the recipient (e.g., individual, small business, large corporation),recipient's involvement with the site (e.g., owner, operator, transporter), nature of the information sought, insurance coverage, and Superfund Recycling Equity Act (SREA).
The collection of questions is intended to assist the Regions in tailoring specific information requests based on the type of potentially responsible party and their involvement at a site. These sample questions are used at the Regions' discretion. In 2010, the collection was converted to PDF files and posted on the Agency's website. The collection, listed by category and subcategory, is now available for downloading in Word format. The date column in the table below reflects the last date the category/subcategory lists were reviewed and updated. As categories and subcategories are reviewed and updated we will post new versions of the questions.
