***On January 10, 2025, EPA published notice in the Tulsa World of EPA Region 6’s notice of intent to deny the UIC Class VI permit application for CapturePoint Solutions, LLC, in Osage County, Oklahoma. On January 8, 2025, CapturePoint formally withdrew its permit application. As a result, EPA is no longer proposing a decision or holding a public comment period.***

PURPOSE OF PUBLIC NOTICE

This notice serves to state the intention of the U.S. Environmental Protection Agency, Region 6, (“EPA Region 6”) to deny two (2) Underground Injection Control (UIC) Class VI injection well permits under the authority of the Safe Drinking Water Act (SDWA) and UIC Program regulations [40 CFR Parts 124, 144-146].

DENIAL INFORMATION

The proposed Class VI permits are for two (2) Class VI injection wells (NBU CCS 1 and NBU CCS 2) that would have been used to inject carbon dioxide for the purpose of geologic sequestration near Shidler, Osage County, Oklahoma, on Osage Nation tribal lands.
