Voluntary Cancellation of a Pesticide Product or Use
Overview of the Voluntary Cancellation Process
A registrant can cancel the registration of a pesticide product or cancel a use from the product’s label at any time as stated in Section 6(f) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). To implement a voluntary product cancellation or use termination, the registrant should submit a letter to EPA (to the product manager or chemical review manager) requesting voluntary cancellation of the product or use(s). To cancel one or more uses, while retaining other use(s), submit a revised label with the changes highlighted. See Chapter 21 of the Pesticide Registration Manual for information on submitting such a request, including the appropriate distribution code.
After receipt of the letter, we will publish a notice in the Federal Register with a comment period of at least 30 days. FIFRA provides for a 180-day comment period for certain actions. However, the registrant may request that the Agency waive the longer comment period in favor of a 30-day comment period, which speeds up the approval process.
At the conclusion of the comment period, unless there are substantive comments or the registrant rescinds the cancellation request, EPA publishes the final cancellation order and, for products with retained uses, approves the revised label. If the Agency has received substantive comments, we may modify or reconsider the cancellation as appropriate.
Voluntary Cancellation Related to a Data Call-in
If EPA has issued a data call-in (DCI) and the registrant opts not to provide the required data, the registrant can instead request a voluntary cancellation of its product(s) or affected uses by:
- completing a Data Call-In Response form (Attachment 2), which is included with the DCI and mark item 5 on the form; or
- submitting a letter and label requesting voluntary cancellation.
A registrant who chooses this option for all affected uses does not have to complete any other forms related to the DCI. In either case, EPA will follow the cancellation process described above.
If the registrant chooses to respond to the DCI using the Pesticide Submission Portal in the Central Data Exchange (CDX), then the Data Call-In Response form as well as the letter requesting voluntary cancellation can be submitted electronically through CDX. Access the CDX.
Sale of Existing Stocks after a Voluntary Cancellation
If a registrant chooses to voluntarily cancel a product or use(s), further sale and distribution of that product/label after the effective date of cancellation must be in accordance with the existing stocks provisions, which are contained in Section IV-Cancellation Order of the cancellation notice.
