Summary
EPA is providing notice of filing of an administrative complaint and notice of opportunity for hearing against the State of Alaska Department of Transportation and Public Facilities (respondent) for violations of the Clean Water Act.
EPA alleges that the respondent discharged dredged and/or fill material without Clean Water Act section 404 authorization into wetlands adjacent to tributaries to the Gastineau Channel and wetlands adjacent to the Gastineau Channel at multiple locations in Juneau, Alaska.

These are Class II administrative penalty proceedings, governed by Section 309(g) of the Clean Water Act, 33 U.S.C. § 1319(g), and the procedural rules found at 40 CFR Part 22. The requirements that apply to public comment and participation are set forth in Section 309(g)(4) of the Clean Water Act, 33 U.S.C. § 1319(g)(4), and 40 CFR § 22.45.
