State/Territory-Designated Top-Priority National Priorities List (NPL) Sites
Section 300.425(c) of the National Contingency Plan (NCP), the Federal regulation by which CERCLA is implemented (55 FR 8845, March 8, 1990), allows States or Territories to designate its top-priority site without the need to apply the Hazard Ranking System (How Sites Are Placed on the NPL). States and Territories may make only one such designation. The selected release should be one that the State or Territory has identified as presenting the greatest danger to public health, welfare, or the environment among the known facilities in that State or Territory.
