Toxics Use Reduction Institute (TURI) Petition to Add 25 Chemicals to the TRI List
In 2014, the Toxics Use Reduction Institute (TURI) submitted a petition under Section 313(e) of the Emergency Planning and Community Right-to-Know Act (EPCRA) to add 25 chemicals to the EPCRA Section 313 list of toxic chemicals subject to reporting under the Toxics Release Inventory (TRI).
EPA evaluated the 25 chemicals to determine if they met the TRI listing criteria of EPCRA §313(d)(2). In response to the petition, EPA added 12 of the 25 chemicals to the TRI chemical list in a final rule published on November 30, 2022. In separate, unrelated actions, three of the 25 chemicals (1-bromopropane, nonylphenol, and 1,2,5,6,9,10-hexabromocyclododecane) were previously added to the TRI chemical list.
Of the remaining 10 chemicals, EPA determined that the available data for nine chemicals were not sufficient for EPA to find that the chemicals meet the EPCRA §313 listing criteria for human health or ecological effects. Regarding the final chemical, EPA did not add octabromodiphenyl ether, as EPA's production volume screen indicated that no TRI reporting forms would be filed for this chemical.
