Ozone-Depleting Substances (ODS) Recordkeeping and Reporting
EPA has issued a series of regulations to phase out the production and import of Class I and Class II ozone-depleting substances (ODS). The regulations include reporting and recordkeeping requirements for producers, importers, and exporters of Class I and Class II ODS. EPA provides reporting forms and instructions to assist entities in fulfilling these requirements. These Microsoft Excel-based reporting forms are required to be submitted to EPA through the Central Data Exchange (CDX). To submit a report through CDX, you will first need to register with CDX and sign an electronic signature agreement. Petitions for imports of used ODS (for both destruction and reuse) must also be submitted through CDX.

Report Submission Calendar
Both Class I and Class II reporting forms are due 45 days after the end of the reporting period. A detailed control period calendar identifying when specific reports are due is also available.

Petitions
EPA allows the import of used ODS to ease the transition to ODS alternatives. EPA has a petition process to verify that the ODS were actually used. Petition requirements are available in 40 CFR 82.13(g)(2) and 40 CFR 82.24(c)(2), (3), and (4). EPA must receive the petition 40 working days before the shipment is to leave the foreign port of export.
The petition must be submitted electronically through CDX, on an as needed basis, and include the following information about the used ODS:
- From what type of equipment was it removed?
- Who removed it?
- When was it removed?
- How much was removed?
- What chemical was used to replace the ODS, or was new equipment installed, or was the equipment no longer needed?
- If new equipment was installed, what type of equipment is it?
- If it is used halon, was it from a halon bank?

Imports for Destruction
The Certification of Intent to Import for ODS Destruction must be submitted electronically through CDX and must include this information:
- How much is being imported for destruction?
- Who is the importer and who are the intermediaries assisting in aggregating the ODS for destruction?
- Which U.S. Port of entry and when is the exempted date of arrival?
- Which country is it being export from?
- Who is destroying the ODS and where is the facility located?

Recent Updates to ODS Reporting
All reporting forms are available in a Microsoft Excel format for electronic submission.
What are the improvements?
• Streamlined and Smarter: Communications from EPA are now sent electronically through CDX.
• Smarter: Strong protections for confidential business information (CBI)
• Streamlined: EPA consolidated the 36 reporting forms (28 print-ready and eight electronic) into 16 electronic forms. Print-ready forms are no longer available.
• Smarter: The e-reporting forms contain data validation capabilities that prevent incorrect entries. These validations reduce error and inefficiencies associated with manual submittal.
• Smarter: The new application includes a submission history table that is easily searchable and viewable by all users within the same organization.
• Smarter: The new application includes validations that help ensure accurate and complete report submission packages.
• Streamlined: ODS reporting requirements are now the same for both class I and II substances including the timing and frequency of submissions and the requirements for attachments.
What remains the same?
• Secure Method of Reporting: All CBI and security procedures for online reporting remain. EPA places a major emphasis on the security of reported data.
• Method of Reporting: Online reporting continues to rely on CDX.
• Electronic Reporting Format: The e-reporting forms remain in Microsoft Excel. The process of generating a csv file also remains a critical step in the process of reporting.

HFC Reporting
EPA has issued a final HFC Allocation Rule under the AIM Act to phase down the production and import of hydrofluorocarbons (HFCs). The rule includes reporting and recordkeeping requirements for entities and EPA provides reporting forms and instructions to assist entities in fulfilling these requirements.
